Insurance for vessels passing through EU territorial waters

The European Commission has adopted a new measures to enhance maritime safety and environmental protection around the EU’s coasts via an amendment to the Vessel Monitoring Directive (2022/59/EC).

As a result of these changes, all vessels, including those merely passing through EU territorial waters without entering an EU port, will be required to provide an evidence of existence of insurance for maritime claims in accordance with Article 4 of Directive 2009/20/EC, as well as civil liability certificates issued in accordance with 1992 Civil Liability Convention, 2001 Bunkers Convention and 2007 Nairobi WRC.

Following this legislative change, the European Commission has submitted a proposal to the IMO seeking the amendments to several existing Mandatory Ship Reporting Systems (MRS) in and around the European coastal states.

Member States will be required to implement the directive within 6 months of its publication in the Official Journal of the EU.
