The Data Act is an EU regulation that aims to guarantee that both commercial and non-commercial users of products or services that generate data can access and utilise that data. The regulation applies to both personal and non-personal data and will apply from September 2025.
The Regulation introduces an obligation to inform the user of, among other things, the scope of the data generated, how it is generated, stored and made available.
In practice, this means that a port terminal using computerised cargo handling equipment will be entitled to request the telemetry data it generates from the supplier of that equipment. It will then be able to use this data to optimise its work processes and improve automation.
