The U.S. Ocean Shipping Reform Act of 2022 may affect the legal position of EU merchants

On 16 June 2022, the US Ocean Shipping Reform Act of 2022 came into force.

The new legislation extends the powers of the Federal Maritime Commission – the US shipping regulator – to include, among other things, the authority to investigate freighters’ complaints about freight rates and D&D charges.

Given that the Federal Maritime Commission’s authority extends to the carriage of containers by sea to US ports, the beneficiaries of the new law may not only be US, but also European freight forwarders and cargo owners, who freight on the Atlantic route.
