The amendment to the Competition and Consumer Protection Act is intended to implement Directive (EU) 2019/1 of the European Parliament and of the Council of 11 December 2018, which aims to empower the competition authorities of EU Member States to enforce competition and consumer protection law more effectively and ensure the proper functioning of the internal market. In the event of insolvency of associations of undertakings, such as chambers of commerce, employers’ organizations, professional self-governments or sports associations, the draft provides for subsidiary liability of its members. Fines imposed by the Office of Competition and Consumer Protection on such associations are also to be higher. The maximum fine imposed on an association would be 10% of the total worldwide turnover of all members of the association operating in the market affected by the violation.
