Omnibus Directive – new rules for trade and e-commerce

EU Directive 2019/2161, the so-called Omnibus Directive increasing, among other things, consumer rights and imposing an obligation on traders to inform about the lowest price of a given product or service in the last 30 days – which is supposed to prevent customers from being misled about the attractiveness of a promotional offer – came into force on 28 May 2022.
The Directive will soon be implemented in Polish law, most likely with the implementation of further EU consumer protection directives (2019/771) amending the rules on consumer guarantees and the rules on the supply of digital content (2019/770) establishing specific conditions for contracts for the supply of digital content or services.
